Senator Pamela Althoff recently sponsored a constitutional amendment, SJRCA 26, to create a new section on unfunded mandates. Unfunded mandates put a financial burden on local taxpayers and units of local government such as schools and municipalities, which are already facing financial challenges.
The amendment would require the State of Illinois to reimburse units of local government if the law requires them to establish, expand, or modify their activities in any way that would require additional expenses. The state would be required to cover the costs incurred by the local governments charged with carrying out the mandated activity. The only exceptions would be if the mandates were requested by the unit of local government affected or were effective prior to the effective dates of the constitutional amendment.
The amendment failed to pass out of the Subcommittee on Constitutional Amendments and will not be moving to the Legislature for a vote. This is one of many bipartisan, cost-saving measures that have been stalled in the Senate this spring.
